Well, I agree with you, Shoe, in general terms. Strict legalities, I don't know (not a lawyer).

The whole thing is totally and completely revolting!

It appears that only the proponent of the measures against management, his companies, plus Deep Discount Advisors (one of the fund's largest holders) and its principal (who had planned a mailing to shareholders), actually were named as defendants, though the internet postings of others are described at length in the complaint, and the relief sought includes an injunction against, and court-ordered "corrective" statements from, those "acting in concert" with the defendants, as well as the defendants themselves. The complaint is long and discursive, though IMHO it contains little particularity with regard to any materially misleading statements. The length, and four named attorneys (including one "of counsel") may bode ill for this year's expense ratio. :>)-- Shoe
