As you said there never was any "illegal" shorting as it is legal for Canadians and MM's to short any BB stock. As of now Mr. X has in fact shorted against the box. But the two brokers still have a problem in that it is a box filled with paper that is not very liquid. If he has been able to sell his future options to the MM's he has certainly taken a dramatic haircut. A lot has been said about everyone moving their shares out of a margin account to a cash account. Some feel it would not have an effect but IMO if Mr. X and friends plus the MM's continue to sell against a box full of restricted paper and options I believe it could cause them a few sleepless nights. Just something to think about.
