As I recall the new constitution was set in place in late 1995 or early 1996. Cyril Ramaphosa was the lead figure in overseeing all proceedings that led up to this and he resigned from politics shortly after this to take up the CEO position of New Africa Investments.

When exactly the new constitution came into existence is not really relevant as it is in place.
I dont think that there are loopholes to be exploited,as the constitution was put into place to protect individual rights.
Once again, I reiterate, the same legal system has been available to all the parties concerned.
