I thought the source code was released for everyone to use it commercially with the condition that the modified code has to be made available to NSCP. Why in the world would anyone bother to spend their time to improve a company's code if they can not use it commercially?

I am sure MSFT can include the code if it is publicly availalbe. If this is so, imagine if MSFT made a Navigator that is incompatible with NSCP DHTML yet compatible with MSFT DHTML and Active X, giving it away as an alternative to IE. It would do NSCP no good to have the code even if they get it, because to do anything about it they would have to modify thier DHTML, which is very impractical. You could not really sue MSFT in good faith, for they improved the browser according to at least my understanding of the contract - at least in thier eyes:-).
