Before everyone gets all over me too. I missed out on an opportunity for a 15% account gain this morning due to slow processing. I was NOT pleased to say the least. But seeing some ownership of the problem and issues.....
" We performed several hardware and software upgrades last night, and thus minimized delays this morning, despite the
same high level of activity. We have also accelerated our NASDAQ order processing system upgrade, due to be
completed in early August, so that it might be done as early as 1 June. These upgrades will improve system
performance almost daily, we won't be waiting until June to bring you LOTS more order processing power. "
........ Makes me feel a bit better. I am not looking to make my living with trading on Datek, I am an active watcher but infrequent trader and try as I might I could not find better services and prices for what I wanted to be able to do....It will even be better when we get Level II and I don't need to send the other guys $50/mo <gg> .

Thanx Again Peter for listening, responding and showing us there still is a Human by the keyboard who's 'Clue Bit is Set' and 'Gives a Dxxx'....

What does this lame ass excuse have to do with the fact that the daily activity page takes 15 min to show an order is that Nasdaq fault and why do other brokers fail to suffer the same incompetence as you. I give you credit for your continual denial of any problems that is one area you are 100%. Also your smug crap answer is a great source of comfort to the customers who have last thousands. Don't rush your upgrade you may not need it i have a feeling your servers will be experiencing a lot less volume. Get off your perch cruise around a chat room check out some online forums see what your crap is doing to people.

I put in a order then it did not get filled, and on open orders
it shows nothing, what is this about, in the messages it shows
my order with the tracking #, but I can not cancel the order
because it shows no activity. Please explain.

Filing A Customer Complaint

Last updated on: 9/17/97

If you believe you have been subject to unfair or improper business conduct by
your broker, you should complain to the brokerage firm promptly in writing. First
communicate your concerns to your broker, then to the manager of your broker's
office. Follow-up immediately if you do not receive a satisfactory response to your
complaint. Continued failure to receive a satisfactory response may warrant your
filing a complaint with NASD Regulation.

If you believe that you have been defrauded by a brokerage firm or one of its
brokers, NASD Regulation wants to know about it immediately. Often, violations
of our rules and the federal securities laws come to light through the receipt and
investigation of customer complaints.

You have several options when filing a complaint. You can send an Internet
complaint letter using our Customer Complaint Form (see notice below) or you
can send a complaint letter to the NASD Regulation office nearest you. Also, in
situations where time is of the essence or you feel that you need immediate
contact, you may call the NASD Regulation office nearest you.

When sending a letter, please include sales confirmations, monthly statements
for the relevant time period, and all relevant correspondence with the firm. Your
complaint letter itself should contain the following information:

the name of the brokerage firm and the individuals at the firm with whom
you dealt;
the name of the security or securities that are the subject of your
complaint or a detailed description of the practice or behavior that are the
subject of your complaint;
the date or dates of the problem activity or transaction;
a detailed description of the events and circumstances surrounding the
activity that is the subject of your complaint; and,
your complete address and a phone number or numbers where you can be
reached.

The focus of the NASD Regulation's investigation is regulatory in nature. NASD
Regulation's investigations do not necessarily result in the return of customers'
money, even where formal disciplinary actions are taken and sanctions imposed.
You are encouraged to consider other avenues of redress including Arbitration
and Mediation if you are seeking to recover monies or securities.

Your statement that your servers are over loaded !!!,is a bald faced lie !!!or your rep. on the mirc stock chat channel is a lier !!!he said and i quote ( are servers are never busy the 1st hour, or last hour of trading }, that was in responce to my question as to why i can't get filled the 1st. or last hour of trading. He said it must be my ISP,,, lol , wonder if my phone is hooked to an ISP too !!!? I printed out the log with his responce , along with your post on SI .Every one i suggest, when you get screwed by Datek you print out your time of sale from level 2 !!! then match it up with your Open Orders ,Portfolio,Daily Activity ,History , and print those out, matching those 5 print outs will show Dateks screw up. Then with anough people ,and here should be thousands , by all the chat channels i moniter,send to 20/20 thet would love it !! ,also SEC. and more important your State Atty. Generals Office , as they have to be licenced in each State !!!! shades of AOL , cig Co's. I have been printing for 4 months . PS: they don't want you to use your own money,they are making at least 2% on the interest spread !!! Could run a billion a year !!! Also watch island MM on bid , if you try to buy between the spread , and island = ( datek ) is setting on bid they will jump the bid up so you can't by !!!!!
Just need alot of people to print and send !!!!!
