You make a good business case which has in fact been Intel's justification for this practice. You're thinking too rationally. Forget about 90 percent of what you know, drink a couple of beers, watch a few X-files reruns and you will begin to develop the mindset of the government types who will be driving this.
They will raise the case of a monopoly company using its dominance of the market to ruthlessly deprive competitors of the smallest foothold in the market. They will use the facts which support their case and ignore or ridicule those that don't. They will trot out 'industry experts' who tell terrible tales of being crushed by the Intel juggernaut. Facts, and in fact any resemblance to reality, will be hard to find.
We are developing a political environment where it is OK for losers in the competitive landscape to punish the winners by getting the government to hobble the leaders. Even the effort involved to defend current practice can be a serious distraction.
I have been dealing with intel since the late 70's and I enjoy their style and competitive drive, I am a believer in the 'if you can't stand the heat stay out of the kitchen' school of business. My point in these posts is that Intel may be faced with a situation where their strengths are minimized and their weaknesses magnified, and the outcome could create problems both for them and the industry they serve.
