greg p,

Sounds like progress in fighting the suits instead of bowing to the pressure and accepting a punishing settlement from congress. This should help the price of MO a little.
""OAKLAND, Calif., May 5 (Reuters) - Major U.S. tobacco companies said on Tuesday they were pleased with a federal judge's order that guts a
racketeering lawsuit brought against them by union welfare funds in California.

In an order filed April 30, U.S. District Judge D. Lowell Jensen dismissed all but one claim brought by the Stationary Engineers Local 39 Health
& Welfare Trust Fund and the Carpenters Health & Welfare Trust Fund for California.

The lawsuit was one of about 33 cases filed by union health trusts in state and federal courts around the United States.

The lawsuits are similar to those filed by 40 state attorneys general that allege the tobacco industry hid information about the health risks of
smoking and the addictive nature of nicotine. Those cases seek to recoup Medicaid funds spent on smokers.

In the lawsuits brought by union health funds, which supplement employers' basic medical benefits, the plaintiffs allege they spent millions of
dollars to provide medical benefits to health plan participants and want the tobacco companies to reimburse them.

Jensen dismissed claims alleging racketeering, state and federal antitrust violations, fraud and misrepresentation, intentional breach of special
duty, unfair business practices and unjust enrichment.""
