That is exactly the issue the court must decide; specifically, what is covered by the licence. You will recall that the judgement also said certain things were not included. So the question is, is the new technology part of what is included or excluded. If the agreement is ambiguous then recourse may be had to the intention of the parties. This may or may not help. Its up to the Judge now. He may or may not decide it in a summary fashion. If he doesn't we may be in for a long trial.
