You're right in your thinking. FDA process is a two-way street. Companies pay the FDA for the cost of evaluating their products/drugs. It is very much a collabrative effort. Someone involved in their application must have signaled that they had a chance for approval. However, the company should have stayed on top of it due to its potential impact (both good and bad--which we all found out too well).

Lots of support in Congress for reforms at the FDA. It should help, but lets not kid ourselves. Anything involving the government takes a long, long time to implement. Committee this, committe that....
