I understand the line of reasoning which proceeds that the xdate
cannot be 5/29/98 because the filinf was not done because the
CUSIP was not established.

However, do we KNOW that the NAZ can't set a retroactive xdate?

Or are we still guessin' and hopin' ...

Gabard:
At this point whether one buys MIDL or W profit is pretty much
same as you get on one W for (.25 +.5) or a MIDL share
for .75(approx).

Gary...you wrote:

... I have found out today that Dan did not do the CUSIP paperwork and it has been submitted.

My question:

I am curious as to why Arcon's SEC attorney did not stay on top of this.

Maybe Arcon needs more effective legal representation in this area.

If papers "get lost" in the in-basket on the presidents desk....it seems that the attorney should be all over him to make sure the deadlines are met. If the president is not cooperating for some reason, there are ways around that also.

You spoke to them/him......what was your take on their reasons for the delay or did they just blame it on Dan?
