How short do you consider short term? If you buy now, and sell in a year (long before prior art becomes a factor) how is that a long term loss. I have bought and sold three times. I never buy when its high, even if it goes to zero, I have a gain now. If it goes to 1 or 2 or 10, I sell at a huge gain, and don't care what the prior art is.

Also, you are assuming the patent covers ANY download in your analysis. That is wrong, it must be an element by element analysis, and done for each claim at issue.

OT Were you in the Cal Fed goodwill lawsuits? I am in that one (have been since beore it started), and so far so good.
