As I continue to research, it appears that the date the MM's must report short positions is the 15th of the month. I had been told the end of the month, and also the third Friday. But the black and white reg appears to be the 15th. I regret the prior inaccuracy -- it was based on oral information from sources that I had good reason to believe were highly informed.

The Search utility in the NASD manual will turn up this information if you search on the words "short" "report" and "15th" in the same paragraph. Links to manual to do not work unless you are in the manual itself.

One document here, from 1993, indicates that Frankel is violating the law by shorting at prices less than 1/16 above the bid.

The rules about MM's having to escrow capital for short sales are labyrinthine. You will find the beginning of documentation on this if you search on "net capital rule".

Hope you're reading this, Mr. Frankel. Maybe Sherlock will tell you all about it.
