So what hold this stock from moving up?

Uncertainty. It's not gone. The Street absolutely will not support MO above 40 until there is a settlement and the unknowns are quantified. The MM's don't care that $600mm has been shot down. They want to know for sure its $300-400mm and that BT will get some guarantee about future law suits. The individual investors can't push this through 40 on their own.
