R.C. I think MO would agree with your reasoning. That is why they entered into the June 97 agreement with the Attorney Generals.
Clinton may be desperate enough here to push hard for the Hatch-Feinstein bill when he comes back from China this weekend. The problem with this bill is that it bothers adult smokers and many long term shareholders of MO. More importantly, in order to get this bill passed, with all the fanatics on both sides of this issue, requires very strong Presidential leadership, which I don't think is there.
The lawsuits keep coming: Another one in Florida against MO in regard to deceptive trade practices concerning the levels of nicotine in Marlboro Lights. Moreover, a global summit on tobacco is coming to the United Nations this summer.
On the bright side, earnings will probably beat the consensus of 82 cents, due to the strong cigarette price increases. MO continues to increase its domestic tobacco market share against its competitors. This is a great company, but a reasonable settlement is needed, with class action liability protection and a reasonable liability cap. As a non-smoker, I can support the Hatch-Feinstein bill, but the fanatics on each side can't live with it.
