Recent Developments:

The move by the tobacco industry to settle with the other 46 states is a step in the right direction. Keep in mind, however, that this does NOT eliminate the RISK associated with the Class Action liability suits that have been filed in N.J. recently and which is presently under way in Florida.
The tobacco industry needs a comprehensive national settlement with CLASS ACTION LIABILITY PROTECTION! These lawsuits are like Cancer: they spread like wildfire with no end in sight. The Risk is that one may eventually cause great damage.
If a settlement with the States is reached, the stock may very well spike to the $45 level; but I don't see it holding there for long. Without Class Action Liability Protection, the stock would still represent to much Risk for the Street.
I wonder if the most recent leak of settlement talks has as its ultimate purpose a message to Congress to get back to reality. The Hatch- Feinstein bill bothers many people. But it gives the Industry and the Street exactly what it craves: class action liability protection. There is nothing else on the horizon to bring the stock to the $55-60 level.

PS. Mr. Black is an excellent analyst. But I think he is minimizing the risk associated with the most recent class action lawsuits. It only takes one loss to do great damage.
