Fowler,

In the case of any BTA licenses (acquired thru the MDS auction) still due payment to the FCC, these could be forfeited if CAI defaulted on a scheduled payment. Any other MDS licenses which were applied for or granted by the FCC prior to the auction would be subject to forfeiture only if the licensee failed to meet its construction certification deadline. Other compliance requirements may also apply. Bankruptcy of the owner does not constitute for automatic forfeiture of a FCC license, but if the licensee was unable to maintain the license as required for whatever reason (including hardship), the license could be forfeited.
