Scott,
Given the lengthy delay in putting out the response, I too thought the statement was not well-considered. I kept asking myself: what is their intent here? It sure doesn't inspire investors, who would have been looking for something like: "We've taken some time in responding in order to review the substance and now that we have, we have consulted with our legal counsel and find the case has no merit whatsoever and we are confident...blah blah blah."

Instead we get a statement that basically says to investors: "Here, have some uncertainty about this mess. We're distracted from our mission and our time and resources are being consumed to an unknown extent." Geez. What were they thinking? Were they looking for somebody to commiserate with them or something?

FIrst, lawsuits are covered by insurance. Second, responding quickly to ambulance chasers only gives them credibility. Rest assured, the only ones making any money from these lawsuits will be these law firms.

Unfortunately these lawsuits are a distraction to management and I wish they would pass legislation once and for all to knock this nonsense off.
