It might make an argument easier at trial (Clinton's) to exclude those tapes if they are found to be made illegally. However, that is not a sure thing because a lot of evidence which is not admissible otherwise can be used to impeach a witness credibility under the rules of evidence. Ms. Tripp has a number of defenses such as your suggestion that federal law trumps MD law. Also, under the MD law, she needs to have known what she was dong was illegal. Indications are the State would have a hard time proving that.

As for the purpose of pursuing the prosecution, they could be twofold. First, intimidation of Tripp. Second, if the tapes could be excluded it might impact on any factfinder's decision as to the credibility of Lewinsky's testimony. Remember, she has told conflicting stories. But REALLY, the most likely answer to your story is simply REVENGE. After all, its reported that Clinton and Lindsey warned Tripp via Lewinsky that it would be "dangerous" to cooperate with the IC and that she would be "destroyed". Looks like they are just trying to keep their word. JLA
