From Yahoo: Judge Denies Lexar Motion to Dismiss Patent Infringement Lawsuit Filed by SanDisk SUNNYVALE, Calif.--(BUSINESS WIRE)--Aug. 11, 1998--SanDisk Corp. (NASDAQ:SNDK - news) announced today that a United States District Court Judge for the Northern District of California in San Francisco has denied a Lexar Media Inc. motion to dismiss SanDisk's patent infringement complaint. The action was filed against Lexar on March 23, 1998. Lexar's motion requested sanctions against SanDisk and dismissal of the complaint for SanDisk's alleged failure to perform an adequate prefiling investigation prior to filing its infringement action against Lexar. In denying the motion, the court found that SanDisk had in fact performed an adequate investigation and that SanDisk could proceed with its infringement action involving Lexar CompactFlash(TM) memory cards. SanDisk has charged that Lexar, Fremont, Calif., is using SanDisk's patented innovations in an attempt to unfairly appropriate some of SanDisk's business.
