A Florida appeals court has ruled that the Widdick/Maddox case should not have been tried in Jacksonville, upholding a pre-trial motion by Brown & Williamson Tobacco Corporation.

The appeals court found that the "trial court abused its discretion in denying" Brown & Williamson's motion to transfer the case to Palm Beach where Mr. Maddox lived.

Etc., etc., etc.

Looks like CNBC dropped the ball after all.

What's this - MO will be restating Q2 numbers (only a few cents) to reflect litigation charges. So far the market doesn't seem to concerned. Any thoughts on the matter.

Thanks,
