The patents that Erickson are contesting number 10,however CDMA is very complex. I agree that Engineers can circumvent but the cost and dificulty would be prohibitivly more expencive then buying IPR. There are hundreds of other Patents that ETSI have agreed are essential. That is a fact. Qualcom also manufactures ASIC chips and handsets, and have a huge technichal advantage. Their on a 5th generation ASIC, whille Nokia the closest 2nd is on 2-3 generation. For all intensive purposes WCDMA doesnt exist. It is simply CDMA2000 at a diferent bandwith. Thats it. It is nowhere near copleation, and CDMA2000 will be rolled out in a year. The question you might ask is "is it worth spending millions on a system that allready exists, and can be liscenced. Its easy to justify that ERICY,LU, NOrtel etc could develop a type of WCDMA, however they havnt yet and they as tero has put it are a dollar short and a day late. Even in your evil world where a company is stripped of its rights and WCDMA did exist without Qcom, Qcom would still flouresh. This is simply because they are in the lead in CDMA technology. They would have all their proprietary markets Korea, Jaqan,S.america,Brazil,USA plus now Europe would be open for their ASICS and Handset sales. Furthermore they have rock solid contracts regarding any form of CDMA with their vendors! Do you understand how CDMA is diferent from WCDMA, if you do youll understand what im saying. If you dont it would be futile to argue with you!
