I'll reveal a secret that few people know, about one way a shorter can obtain shares legally, even for OTC BB stocks.

If you have a margin account, take a close look at the fine print in the agreement. For just about every brokerage, they include a clause about how any stock in a margin account can be loaned out without your consent, or even knowledge.

By the way -- I've had other brokerage accounts in addition to E*Trade.

I just found the shorter's thread here on SI, and what do you know, there was a posting about shorting shares you own. Check out techstocks.com .

So, go ahead and make a fool of yourself with the SEC when you ask them about the legality of shorting OTC BB stocks.
