MD, I see a 5% downside risk if the Gov't does sue for a trillion. But keep in mind, this is a Medicare class action law suit that has as little merit as the ones that have been dismissed all summer. Actually, this potential suit has even less merit than the others. ( I'll explain why once the suit is filed ). The purpose of the suit, if filed, would be to prevent a settlement between the tobacco industry and the states and make the tobacco industry return to a Comprehensive National Settlement. Wouldn't it be interesting if the tobacco industry settled with the remaining 40 States regardless of the Federal class action law suit! The State Attorney Generals and the Tobacco Industry are fed up with the Federal Gov't ( they had their chance ) and they are going to make a DEAL here Regardless! I respectfully disagree. I think the stock would snap back quickly once investors realized the purpose of the Federal Lawsuit and its inability to prevent an agreement between BT and the States!
