After all those victories for the tobacco companies, wouldn't it be logical or even necessary to avoid any settlement? Since jurisdiction has thrown out all suits and there was no need to pay any money to anybody; don't have the companies the duty to avoid any payments to anybody to the benefit of their shareholders? The only payments which were made, were those following a settlement (and of course it remains an open question whether they would have to pay anything after a court decision). I don't know what I would do in their situation, but after all victories I get the feeling that they would give away the money to easily after a settlement with the state attorney generals.
Any comments?
