Court Closes Microsoft Depositions nytimes.com

The U.S. Circuit Court of Appeals for the District of Columbia decided Wednesday to let the pretrial interviews move forward immediately but delayed for almost six more weeks a decision whether to allow the public to attend. That will come long after the antitrust trial itself is to have begun.

Oh dear. I leave it to the brilliant legal Mind of Reg(TM) to explain how this is all a stinging rebuke to Jackson, perhaps even a threat to his "carrer", lifetime appointment and all. One way to read it is not exactly favorable to Microsoft, if the "judicial restraint" conservatives had decided to pay attention to the law as written, the depositions probably could have been dragged out for who knows how long, and Bill said they needed more time, right? Meanwhile, in six weeks, the whole thing will be moot. Maybe the "judicial restraint" guys will come up with some Chicago School theory on that law too, even though the issue is moot, just to prove what good friends of Bill they are.
