John, if you recall, the point behind the NY Times article was that CIEN misrepresented its position by a series of omissions from the registration documents. That creates some major problems in evaluating the company's total position because to a large degree these deals are based on trust. My guess is that some institutional investors called Birck and said enough is enough.

Boo Hoo. Lump of coal in my stocking. I have CIEN at 46 but I
have much,much more TLAB that I inherited via CCSC. That looks
just fine this moment. Jeeze, what a noose CIEN seemed to be on
TLABs back. How could you know, how could you know.

I really feel that there is a lot more to this CIEN, TLAB, ATT, and LU
thing than meets the eye. I suspect LU plays dirty pool-- but that is
the way it is. If you can't beat em honestly, screw em anyway you can
