Since the holders can't do that until Nov. 15, the 3rd quarter numbers will NOT reflect these additional shares, however the 4th quarter WILL. Is this correct?

I have indirect evidence based on the market makers activity and the way the stock trades. Only full legal discovery would get us proof (not necessarily recomended). Not much can be done at this point accept to convert them out and let the Company get on with it. The longer these things remain outstanding, the lower the stock will go unless the Company comes out with incredible news.
