First, I would like to make a public service announcement, then I'll get to my response.

TO ALL: The use of impolite language and name-calling doesn't strengthen your argument. Although you may feel very strongly about certain issues and have very strong emotions about the poster, let's try to keep things reasoned and logical. Keep your heart off your sleeve and try to keep your emotions under control. Ranting and raving doesn't advance one's argument and makes one look foolish.

If you really want to blow off some steam, feel free to PM me and be as vulgar and offensive as you like. I really won't mind and it'll help keep the thread clean and tidy.

Now, on to bigger and better things....

Congress can make no laws that deny any citizen their rights under the Bill of Rights.

Point of law: The Congress can (and frequently does) abridge or limit the rights of citizens as defined under the Constitution.

Take the 4th amendment, for example. Where does it say I can't carry a loaded Uzi with an extended clip with me when I visit the local playground? The fourth amendment says that I have the right to "bear arms". Congress has necessarily limited the rights of people to bear arms under certain circumstances. It wouldn't be prudent nor acceptable to allow me to carry that Uzi around. I know there are those that would disagree with me, but I'm fairly stuck on certain abridgements that are in the public interest.

There are also necessary and commonsense abridgements of other rights. I have the right to peaceably assemble with others, but can I do it in the middle of the interstate during rush hour? That wouldn't be in the public interest.

See where I'm going with this? The Constitution was not meant to be interpreted literally. Neither was the Bible, but that's a different matter. That's where enacted laws and Supreme Court rulings come into play. You can't manage a large-scale industrial society based on a single document. Society's interests at large come before the rights of the individual.
