It is granted that the T.O.N doesn't require FDA approval to be marketed as a dietary supplement. I think that most people realize that so we can cross that topic off the chalkboard.

What the FDA has control of is HOW T.O.N is advertised. The Stevita case clearly shows that Stevia cannot be marketed as a sweetener, which would fall under the category of food additive.

Yes, I disagree with the FDA policy as well, and this "dietary supplement" jargon is just so much legalese that companies like Stevita and AZNT have to use to avoid a lengthy and politically and commercialy biased approval process. I don't like it. I don't agree with it. However, that is the law and AZNT must abide by it in order to protect shareholder's equity value and legal problems which they obviously could not afford to fight at this moment.

I certainly don't want to see another press release like the one that declared they were aiming at the Nutrasweet and S&L marketplace. While eventually that may be what they are aiming at, it places a target on their foreheads in that they are advertising that their "dietary supplement" is appropriate to supercede an approved FDA food sweetener. I suggest that using this kind of verbage equates to walking a fine legal line of definitions. And walking a fine line means that regulators could justify probable cause for launching an inquiry of AZNT. I don't like that kind of brinkmanship.

I certainly hope that AZNT will also provide legally binding clauses in their forthcoming financials that clearly state that their are restrictions on the conversion of preferred stock into the new common shares. I would also like to see verbage that discusses the ultimate conversion ratio.
