it sounds as if that was not an option, hal
in other words, they gave their version of the
literal construction for a finding, and if they were
to agree with Mitsubishi, it would have to accept
their so called "intermittent" theory, or fallacy....
as the court so characterized it.
but,
this speculation is pointless, finally;
until we read the opinion, we will simply be guessing...
and guessing based on speculation as to the actual transcript.
