The logic fails, oh venerable cat -

1. John Doe drinks and drives.
2. Doe causes a serious accident which results in the death of someone.
3. He drives on and no one can identify him.
4. Finally, ten years later, a reporter puts together a story that identifies him as being the culprit, but the DA doesn't think the case is strong enough and it's been too many years.

Given the above, and your path of reasoning:

5. I drink and drive.
6. I cause a minor accident which only results in my arrest for DWI. (First arrest, but in these cases, we know not the first time I've driven while under the influence.)
7. My legal defense is that because no one was ever prosecuted in the previous accident (caused by someone else), that I should not be prosecuted.

Doesn't work for me. Maybe for the Bill Clintons of the world.
