The judge was in the deposition room as the questioning proceeded, and had already indicated she had decided to allow the line of questioning to proceed. And would only rule on its ultimate materiality later, after it had been taken and placed under seal. Such a motion would have been an empty formalism, and probably immediately dismissed.
