It is true that there will always be some room for scam artists in a medium such as eBay provides.

I did have a case where it took me almost a month to get a refund.

You could threaten the post of negative feedback, and you could threaten a small-claims suit, which would probably have jurisdiction in your state.

If this seller has continued to sell, negative feedback and threats to sue (and actual follow-through), could all very likely increase your chances of getting your money back.

I personally would like to see eBay take a more active role in reducing fraud. I know why they are trying to stay away from this big mess, but I do believe they will ultimately have no choice in getting more involved. (For example, if states start threatening them with these cases, eBay will work something out for fear of losing the business in those states.)

You can post negative feedback after-the-fact. However, the problem is the seller will probably retaliate against you, making a refund more difficult to obtain.

I always look at the sellers feedback before I bid. If there is any negative feedback, or a new seller with few sales, I don't bid. Did the seller have any negative feedback at the time you placed your bid?
