Actually, it got started back when Monica showed Bill her thong underwear. But that's another matter.

Taping in my state (Washington) without the consent of all parties to the conversation is illegal too. As a practical matter, people are rarely prosecuted for doing it. It's far more common for someone to tape a conversation to try to gain an advantage in a lawsuit. Then, surprise, the evidence is not admitted because it was obtained in violation of the state statute.

Courts have allowed admission of illegally obtained evidence, however, if it was obtained by a private party? An informer can conduct a search that would be improper for for a cop to do without a warrant, and hand over contraband to the police, and it would be admissible at trial. Same for tapes like these.

I'm not particularly threatened by private party taping, as happened here. What's far more scary is the government spying on citizens and doing the taping. Seems we had that back in the 70's with Tricky Dick. As far as I'm concerned, Linda Tripp's taping doesn't threaten the Republic. Bill Clinton's lying under oath and, if proven, obstruction of justice does.
