Dennis, do you have any basis for saying "...leaving me at risk that the price would drop?" I would expect Brown to force their MM to honor the size so that the MM had that risk. They certainly do that on the listed stocks. If Brown told you to the contrary, who was it?

What was the bid size when you placed your order?
Was it 50 or larger?
If less than 50, the best bidder would not fill you right away.
Additionally... how thinly traded is this stock?

I don't believe you were ever at risk in this situation, only Brown or the MM that received the order was. What bothers me about your story is what the Brown rep said. How can he/she be so ignorant as to think you are not entitled to a fill in this situation. They can sell their order flow to whomever they chose, but the MM who receives it must execute it immediately one way or another if it is marketable, and represent it immediately if not.

I'm happy to report that the rep I spoke to today knew exactly what I was talking about when I complained about only a partial fill on a listed stock when I was due all the shares of my order based on the "as if NYSE" policy. He called the market maker and got me rest of my shares in a minute or two while I stayed on the line.
