We've discussed the issue of regulation on and off on this thread. I stated earlier that it is very difficult to regulate derivatives or the hedge fund industry. Largely because of the rapid change but also because of the hedge funds ability to just move outside of the regulatory environment. There is however one area that can be attacked by regulators. the industry is dependant on large amounts of leverage. The source of that leverage is large financial institutions and it would be possibly to effectively control hedge funds by exerting capital controls on the banks. I am not advocating this just pointing it out as a potential control lever.
