The action by the MM's today absolutely confirmed a short position out there. We started the day with a string of buys that took us up to a little after 3:00. The MM'as made no attempt to raise the ask, then from about 3:25 they walked the bid down on very few sells which in my opinion included a few phony ones. IMO they are confused by the continued buying coming in and have no choice but to continue the short.

Normally when I talk to Joe Murphy I mention it only to my E-mail group but I think the following information is for everybody. The company was in discussion with the enforcement division of the SEC today and through Morrow & co. will be talking with the NASD tomorrow.
As we have said on this thread many times it is illegal to short a BB stock except for MM's. They are only permitted to do it to maintain an orderly market. At this point they have created a disorderly market. The results of the conversations with the SEC and NASD will show up in the FQA section of the web site.
