The transfer of digital information, to my knowledge, does not add background noise... If you unzip a text file do you get any distortion from compression and decompression? Similarly mp3's are compressed without loss of sound quality. The sale of the RIO will definitely increase piracy, no doubt about that. MP3 players are an emerging technology, if DIMD doesnt do it, some company from Asia will. RIAA will have a tough time putting a restraining order on some company in Korea...
