The unique entity of a CompactFlash card is being tested in court. Some companies such as SSTI have avoided legal conflict with SNDK by paying licensing fees on their own brand of CF. The "card assembly" patent related to the unique construction of a CF card from silicon, the on-board controller and other standard components necessary for CFA certification is at issue. SanDisk has reverse engineered the Lexar Card and found it to infringe on various patented technologies originated by Dr. Harari and crew. I also believe the feature of the card which identifies and deletes bad sectors from further read/write cycles is patented. This allows for their 10 million picture guarantee on each CompactFlash card sold.

We all know the Lexar suit is pivotal. The motion by Lexar to summarily dismiss the case was denied and SanDisk has been granted additional time to further document infringements with additional reverse engineering investigations, a time and personnel consuming endeavor.

I hope that SanDisk's fierce (and greatly successful!) patent defense continues. They have conquered much bigger foes than Lexar in the past including Intel, Samsung and Toshiba.

With the patent rights, fees and product sales..... If they continue to reduce costs while the demand grows - Sandisk will be a winner long term for all of us.
