Just a note of possible interest. From: ljx.com John Warden, Microsoft's lead attorney, hammered away at America Online for a second day. Warden tried to show that AOL was not a hapless victim but a cunning operator that played Microsoft off against its rival Netscape. AOL has that other legal battle going too.

With this court decision, AOL would seem to have every reason to settle this with BNEZ out of court. Let's see, with just a $1MM settlement, that would provide cash per share just about equivalent to the current $0.32 share price (assuming about 3MM share oustanding). With $10MM settlement......Wow!!!! But seriously, how about a few $MM of PMA ads on AOL. That could do wonders for PMA sales.

In all seriousness, Given that AOL didn't get a summary judgement, do you think that AOL will tend to settle the case. If so, for how much. Stock price decline since then is about ($1.70 * 12 ) * 5 million shares = $100 million. Notes: I'd guess there are about 5 million shares outstanding right now and the price of BNEZ at the time of the misquote was $1.70 (before the 12:1 reverse split). I'd say BNEZ ought to settle for a cool $25 million (i.e. $5.00 per share). Seems reasonable to me!! (LOL) later, leroyr
