AOL can appeal the decision but that would be a real demonstration of weakness and concern. If you read the pleadings it is pretty clear that AOL had nothing but contempt for BNEZ, and that they truly believed that the court had no choice but to rule in their favor. I think the negative psychological effect of the ruling on AOL will be tremendously powerful. BNEZ's pleadings are nothing short of brilliant. I don't believe that AOL would accomplish much on appeal other than making a stronger precedent for others to sue them. I don't know if this will mean a settlement. It might. It might also mean that AOL now has a vested interest in destroying BNEZ as an object lesson to anyone else who wants to sue them. The Microsoft syndrome you might say. One thing is clear, though. The CDA has some flaws, and that has to upset AOL.
