Just an addendum ... when I worked for a software company we were very aware of consumer buying in January. The simple theory was that people got lots of cash as Christmas presents. Some even said it could be a bigger month than December.

From what my retail software buddies tell me, Christmas just ain't gonna be this year for PMA. The buying for seasons is at least 3 months ahead of time, and even though PMA got sent to Ingram, the company still has to sell chain buyers. That doesn't mean the software won't sell. It does mean that retail outlets won't have it for Dad under the tree. Online vendors are another story. Updating lists is a click away, so some holiday sales are possible. I agree with you on the litigation rush. But it should generate some publicity, and that will make people look at the company, and that could have some secondary effect on the price. I'm bullish because (1) the software is tremendous (2) their ad campaign looks good (3) whenever I try to call their marketing people lately they are out of town trying to sell to the chains. The judge's ruling for limited discovery "validates" the suit, IMHO. It shows there is enough to the reason for the suit for the judge to say it should proceed. While very pleased for BNEZ, I keep thinking about the possible precedent this may set for the future and the overall significance this can have for "content providers".

Still, the actual business of the company is foremost, again IMHO. Management has shown themselves to be savvy and aggressive in getting PMA out into the market. With the distribution deals in place and the upcoming Inc magazine ad, this is an excellent prologue to sales. I find myself wondering what will be next, as they have said they were to meet with buyers for major retail outlets. These guys aren't messing around and look to be doing what it takes to get this product out there.

Like others, I don't expect to see significant results or numbers for a while yet, but feel this one is worth my patience. I don't know this myself, but it has been mentioned the buying for the Christmas season has already been completed by those retail outlet buyers for their stores. To my mind, then, this fourth quarter is probably not the time to look for any significant sales numbers, as it's simply still too soon.
