Tom,

>>>>>>> what would have to happen for you to believe that we have
seen the top and that any rally from this point on will be confined to the recent highs?? <<<<<<<<<

1) Market internals to start deterioating would be better, but if they just remain flat at current levels, like the NEW HIGHs.

2) If we dont break the recent highs during the next upswing significantly, thereby forming a double top.

3) The longer we stay below the recent highs, the probability of the top forming increases

4) The BKX, TRAN, XAL continue and increase their downside move.

5) Major overseas markets (JAPAN, FRANCE, BRITAIN, GERMANY) do not exceed their recent highs and forms a DOUBLE TOP.

6) The NAZ to stop its divergence to the upside.

If the FEDs do cut rates, subjectively I do feel the markets could shift slightly higher, and for now I feel 9100 to be the TOP, if that was to happen.
