I asked Cal Nelson(President of Ancor) this question yesterday and he stated that the move to settle the lawsuit was more Ancor's doing than the insurance company's. Essentially the push to settle came about due to Ancor getting tired of hearing back from potential OEM's that the competition(Brocade, Vixel, etc) was using the lawsuit as a argument to the OEM's to not get involved with Ancor. In other words it was used as a scare tactic to keep OEM's away from doing business with Ancor.
