Michael if that is true how does it relate to the NIMH patent in Japan that was issued in 1997 but is only good until 2003. It seems it starts from the application date, so unless ECD waited 20 years to apply for the patent that Retiarius was referring to, the most important fundamental patent if issued would be expired. Anyway I'm sure that we will know more about it this week.

Virtually all of Japan's NiMH battery manufacturers have patent
agreements with Ovonic Battery covering consumer NiMH batteries. With
the patent recognition in Japan, these manufacturers must pay
substantial amounts based on sales for all NiMH batteries produced in
Japan in the past, from the date of publication, until April 22, 2003.
