I do not know for a fact that either of those statements are true or not. My outlook on BTIM is irrespective of the veracity of those two statements.

However, assuming that they are true then I still have no problem. IF Mr. Barkin stated at one point that something was his belief then that should be considered as an opinion. At the time Mr. Barkin could very well have been truthful about his outlook while still being wrong about future events. As you and I both know, the FDA does not give incremental status updates on reviews.

Here's an analogy. I believe that BTIM will trade over 16 in a few days. I am not stating that as a fact and anyone with a knowledge of the markets knows that I cannot make such a statement as fact. If you ask me three weeks from now (if BTIM fails to meet my objective) if I stated that "BTIM will trade at 16 in a few days" I will tell you that I made no such claim of fact. Likewise, anyone who knows the FDA would know enough to realize that Barkin's comments could ONLY be opinion.
