I think a lot of folks do not realize that this is a fundamental basis for this case. Shoprting penny stocks is illegal for a very good reason and this thread offers considerable evidence as to why this practive must not be allowed.

Judge George appears to be sceptical:

Again, you make a very good point {if in somewhat broken english}. You seem to realize something that the FBN BSB'ers either do not recognize, or want badly to deny.

This is a matter called 'specific performance.' It is usually applied to cases where the performance of an action (in this case, return of the stock) would provide the relief sought by the plaintiff and that a monetary amount, such as the amount involved in the breach would not provide.

The possible scenario is not far fetched ... it is probably just misapplied as there should be little probability of that occuring.

Well, I disagree with your viewpoint of what the courts will do, so we'll just have to agree to disagree and wait for the courts to decide.
