I think the judge will rule in favor of MSFT but will try to make them look bad during the trial. Why? He does not want to be embarrassed by the appeals court.- I don't think he likes the. He won't act on his personal feelings but will excercise good judgement.

J,

Shortly after the appeals court received the appeal they ruled against the judge and in favor of Microsoft. The appeals court basically embarrassed the judge.

Not only did the appeals court overrule the judge, they issued a "writ of Mandamus" against him for his procedural violations. Most judges do not have such a sanction levied against them in their whole career. Basically, they came as close as they could to calling him incompetent.

Thanks,

Mike
