I wish I had some cheerful news for you Scooter. But, based upon what you have written here, the title of this thread seems appropriate.

If you gave NDB the time and enough information for them to retrieve the recording of your phone call, and they contend that they have no record of it, I don't know how you can dispute what they say. I suppose it all boils down to who gets to take the loss; you or NDB. Since NDB seems to possess all of the documentation for your dispute, I don't know what you can do except rely upon them to do what's right.

Scooter for the second time: Keeping calling until they accept or deny it(i guess they denied it). Record all dates,times, details of your calls,who you talked to and what they said. Send in a letter of complaint to their president, compliance (legal) department,and to the SEC(via email at top of thread). Often times the SEC will force the brokerage to review the situation and send a copy of it to you and the SEC.Good Luck at least they haven't blown you off yet(they are blowing you off)!
