Did your accountant really say that selling STBI and buying TDFX was a wash sale? They've only entered into an agreement, one that can still be broken by either side.

I'd guess if you sell TDFX now and don't have it in your account for more than 30 days you should be safe from the wash sale rules.

FWIW, I'd consider doing the same thing. In fact I bought STBI yesterday. I should probably short TDFX to lock in the difference. It worries me that CREAF will probably dump their shares on the market (at least I see now reason for CREAF to keep TDFX shares).

Make sure that you read the wash sale section of this page

It says that as soon as the merger is announced, both company stocks are substantially identical to the other.
